If a product offered by EverForgeKS is not as described, your sole remedy is to return it in unused condition in accordance with our return policy.

All prices displayed on the Site are in US Dollars and are subject to change without notice. While we make every effort to ensure pricing accuracy, errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price. We will notify you of any cancellation and provide a full refund. Promotional pricing and discounts are valid only for the specified duration and may be subject to additional terms and conditions. EverForgeKS reserves the right to refuse or cancel orders that appear to be placed by dealers, resellers, or distributors.

5. Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the products in your order. All orders are subject to acceptance by EverForgeKS. We may, at our sole discretion, refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or problems identified by our fraud detection systems. If your order is cancelled after payment has been processed, we will issue a full refund to your original payment method. An order confirmation email does not constitute acceptance of your order; acceptance occurs when the product is shipped and tracking information is provided.

6. Payment Terms

We accept major credit cards, debit cards, and other payment methods as displayed at checkout. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order, including any applicable taxes and shipping charges. All payments are processed through secure, PCI-compliant third-party payment processors. EverForgeKS does not store your full credit card information on our servers. In the event of a payment failure, we reserve the right to cancel or hold your order until payment is successfully processed.

7. Shipping and Delivery

EverForgeKS ships to addresses within the United States. Shipping times and delivery estimates are approximate and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather events, natural disasters, or other circumstances beyond our control. Risk of loss and title for items purchased from EverForgeKS pass to you upon delivery of the items to the carrier. If a package is lost or damaged during transit, please contact us within 48 hours of the expected delivery date so we can assist in filing a claim with the carrier. 8. Returns and Refunds

We accept returns of eligible products within 30 days of delivery, provided items are in their original, unused condition with all packaging, tags, and accessories included. To initiate a return, please contact our customer service team at support@everforgeks.com with your order number and reason for return. Refunds will be processed to your original payment method within 5-10 business days after we receive and inspect the returned item. Shipping costs for returns are the responsibility of the customer unless the return is due to a defective or incorrectly shipped product. 9. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, software, and compilation thereof, is the property of EverForgeKS or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The EverForgeKS name, logo, and all related product and service names, designs, and slogans are trademarks of EverForgeKS. All other trademarks, including DeWALT and associated brand names, are the property of their respective owners and are used for product identification purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Site without prior written consent from EverForgeKS.

10. Limitation of Liability

To the fullest extent permitted by applicable law, EverForgeKS, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content. These Terms and any disputes arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Johnson County, Kansas, for the resolution of any disputes arising from these Terms or your use of the Site. Any cause of action or claim you may have with respect to the Site must be commenced within one year after the cause of action accrues.
